The subject was established in 2020 as one member of TIKTOK PTE. LTD. (TikTok Singapore). In Vietnam, TikTok Singapore established a Representative Office in Ho Chi Minh City and the subject to support service provision activities in the Vietnamese market. The company operates as a sales marketing office, providing services to TikTok Singapore. The services that the company provides to TikTok Singapore are services to support TikTok Singapore's cross-border service provision activities in the Vietnamese market. It does not directly participate in the management and provision of cross-border services into Vietnam through the website of “TikTok.com” and “the TikTok application”. The provision of cross-border services into Vietnam through the website of “TikTok.com” and “the TikTok application” is directly managed and operated by TikTok Singapore. The company has no control over the TikTok business platform or any user data on the TikTok platform. TikTok Singapore is an operator that directly receives payments from sellers on the platform through payment wallets and bank accounts.The subject accumulates and collects fees from the parent company (TikTok Singapore) according to the Cost-plus model. That is, the amount TikTok Singapore must pay to the subject will be equal to costs of goods sold and administrative overheads of the subject, then apply an agreement percentage to get an appropriate profit. In the three years 2020, 2021, 2022, the agreed profit rate is 8.14%, 8% and 8%, respectively. Based on the tax declaration and documents provided by the company, the Ministry of Information and Communications said that in the three years 2020, 2021 and 2022, the total taxes on corporate income, value added, and personal income, foreign contractors and licenses, the company paid VND 127.1 billion. Thus, more than 64% of Internet users in Vietnam are using TikTok. The platform was initially used for entertainment. However, harmful content has been on the rise on TikTok since 2022. Accordingly, The Vietnamese Ministry of Information and Communications has launched a comprehensive probe over TikTok's activities in Vietnam since May 5, 2023. On October 5, 2023, the Ministry of Information and Communications announced the inspection conclusions for the TikTok platform. Storing information that violates Vietnamese law on servers in Vietnam, including fake information, distortion information, inciting violence information, inciting social evils information, and information harmful to children... are common violations of TikTok in Vietnam.According to the service accounting firm of the subject via telephone (84-28) 38290290, the subject does not register landline telephone in Vietnam.
