Designed to resolve some legal and regulatory uncertainties, the new Electricity Law of 2024 (Law Number 61/2024/QH15) and Decision 768/QD-TTg build upon the renewable energy capacity developments that have been made since 2017. The conclusion of feed-in-tariff (FIT) schemes for solar and wind projects in 2020 and 2021 raised risks for projects that did not meet the 31 December 2020 deadline. Projects that failed to complete on time for the FIT1 price of USD 0.0935 per kWh were shifted to the FIT2 scheme, which offered a rate of USD 0.0709 per kWh, a 24.2% discount from the originally planned rates. The conclusion of the FIT2 scheme on December 31, 2021, resulted in a series of projects getting a "transitional project pricing" classification at a rate of USD 0.047 per kWh. Further compounding issues with incentives, the retroactive requirement of a completion acceptance certificate (CCA) in 2023 placed yet more projects at risk of losing their FIT eligibility. In other words, the increasingly lower rates and retroactive requirements have raised investor caution about further developments in Vietnam's renewable energy sector.
